Welcome to Mend & Modern, LLC! These Terms and Conditions ("Terms") govern your use of the website located at www.mendandmodern.com (the "Website") and the handyman services ("Services") offered by Mend & Modern, LLC. By accessing or using our Website and Services, you agree to be bound by these Terms. If you do not agree to these Terms,1 please do not use our Website or Services.

1. Definitions

  • "Mend & Modern," "we," "us," or "our" refers to Mend & Modern, LLC, an Arizona Limited Liability Company, operating at www.mendandmodern.com.

  • "Client," "you," or "your" refers to any individual or entity that accesses our Website or engages our Services.

  • "Services" refers to the handyman services provided by Mend & Modern, LLC, including but not limited to repairs, installations, maintenance, and other general home improvement tasks as described on our Website and in individual service agreements or estimates.

  • "Website" refers to www.mendandmodern.com.

 

2. Acceptance of Terms

By using our Website or engaging our Services, you signify your acceptance of these Terms. If you are using the Website or Services on behalf of an organization, you are agreeing to these Terms for that2 organization and representing that you have the authority to bind that organization to these Terms.

 

3. Services Offered

Mend & Modern, LLC offers a variety of handyman services. The specific scope of work for each project will be detailed in a written estimate, proposal, or service agreement provided to the Client before work commences. We reserve the right to refuse any service request at our sole discretion.

 

4. Estimates and Pricing

  • Estimates: All estimates provided by Mend & Modern, LLC are based on the information available at the time of the estimate. Estimates are subject to change if unforeseen circumstances, additional work, or changes in project scope are identified during the course of the work. Any material changes to the estimate will be discussed and agreed upon with the Client before proceeding.

  • Validity: Estimates are generally valid for 30 days from the date of issuance unless otherwise specified.

  • Pricing: Pricing for Services will be clearly outlined in the estimate or service agreement. Mend & Modern, LLC reserves the right to adjust pricing for services at any time, but such changes will not affect active, agreed-upon projects unless the scope of work changes.

 

5. Payment Terms

  • Deposit: For certain projects, a deposit may be required before work commences. This will be clearly stated in the estimate or service agreement.

  • Payment Schedule: Payment terms and schedules will be specified in the estimate or service agreement. This may include full payment upon completion, milestone payments, or other arrangements.

  • Accepted Payment Methods: We accept cash, check, and major credit cards.

  • Late Payments: Payments are due upon completion of the Services or as per the agreed-upon payment schedule. Late payments may incur a late fee of 5% per month on the outstanding balance, or the maximum amount permitted by law, whichever is less. Mend & Modern, LLC reserves the right to suspend or terminate services for overdue accounts.

  • Collection Costs: In the event that collection efforts are required for overdue accounts, the Client agrees to be responsible for all collection costs, including but not limited to legal fees and court costs.

 

6. Cancellation and Rescheduling Policy

  • Client Cancellation/Rescheduling: If3 you need to cancel or reschedule an appointment, please notify us at least 24 hours in advance. Cancellations or reschedules made with less than 24 hours' notice may be subject to a cancellation fee of 50% of the estimated service cost, at Mend & Modern, LLC's discretion.

  • Mend & Modern, LLC Cancellation/Rescheduling: Mend & Modern, LLC reserves the right to cancel or reschedule appointments due to unforeseen circumstances, such as illness, severe weather, material shortages, or other factors outside of our control. We will make every effort to notify you as soon as possible and reschedule at your earliest convenience.

 

7. Client Responsibilities

The Client agrees to:

  • Provide safe and reasonable access to the work area during scheduled service hours.

  • Clear the work area of any obstructions or valuable items that could be damaged or hinder the performance of services. Mend & Modern, LLC is not responsible for damage to items not removed from the work area.

  • Obtain any necessary permits, approvals, or landlord consents required for the work to be performed, unless otherwise explicitly agreed upon in writing by Mend & Modern, LLC.

  • Provide accurate and complete information regarding the scope of work and any existing conditions relevant to the project.

  • Be present or have an authorized representative present during the commencement and completion of work, and periodically as reasonably requested by Mend & Modern, LLC.

  • Inform Mend & Modern, LLC of any known hazards, such as hidden pipes, electrical wiring, or structural issues, before work begins.

 

8. Materials and Equipment

  • Mend & Modern, LLC Provided Materials: If Mend & Modern, LLC supplies materials, these will be itemized in the estimate or service agreement. Materials supplied by Mend & Modern, LLC are typically covered by the manufacturer's warranty, and we will assist in facilitating warranty claims if needed.

  • Client Provided Materials: If the Client chooses to provide materials, Mend & Modern, LLC is not responsible for the quality, suitability, or warranty of such materials. Any issues arising from client-provided materials may incur additional labor costs for rectification.

  • Tools and Equipment: Mend & Modern, LLC will provide all necessary tools and equipment to perform the Services unless otherwise agreed upon.

 

9. Warranty and Limitation of Liability

  • Workmanship Warranty: Mend & Modern, LLC warrants its workmanship for a period of 90 days from the date of service completion. This warranty covers defects in workmanship and does not cover materials (which are subject to manufacturer warranties), normal wear and tear, or damage caused by misuse, neglect, accidental damage, or repairs/modifications made by anyone other than Mend & Modern, LLC.

  • Limitation of Liability: In no event shall Mend & Modern, LLC, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services or Website; (ii) any conduct or content of any third party on the Services or Website; (iii) any content obtained from the Services or Website; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.4 Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount paid by you for the specific Services giving rise to the claim.

  • Existing Conditions: Mend & Modern, LLC is not liable for any damage or issues that arise from pre-existing conditions, hidden defects, or structural deficiencies in the Client's property that were not reasonably discoverable or disclosed prior to the commencement of work.

 

10. Intellectual5 Property

The content, features, and functionality of the Website, including but not limited to text, graphics, logos, images, and software, are the exclusive property of Mend & Modern, LLC6 and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works7 of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website without our prior written8 consent.

 

11. Links to Other Websites

Our Website may contain links to third-party websites or services that are not owned or controlled by Mend & Modern, LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Mend & Modern, LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

 

12. Disclaimer of Warranties

The Website and Services are provided on an "AS IS" and "AS AVAILABLE" basis. Mend & Modern, LLC makes no representations or warranties of any kind, express or implied, as to the operation of the Website9 or the information, content, materials, or products included on the Website. You expressly agree that your use of the Website is at your sole risk.

 

13. Indemnification

You agree to defend, indemnify, and hold harmless Mend & Modern, LLC, its affiliates, licensors, and service10 providers, and its respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Website or Services, including, but not limited to, any use of the Website's11 content, services, and products other than as expressly authorized in these Terms or your use of any information obtained12 from the Website.

 

14. Governing Law and Dispute Resolution

 

These Terms shall be governed and construed in accordance with the laws of the State13 of Arizona, without regard to its conflict of law provisions.14

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You hereby consent to the personal jurisdiction of such courts.

 

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.15

 

16. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Website or Services after those revisions become effective, you agree to be bound by the revised terms.

 

17. Entire Agreement

These Terms constitute the entire agreement between you and Mend & Modern, LLC regarding our Website and Services and supersede and replace any prior agreements, whether oral or written, regarding the Website and Services.
